("Voice Titans", "we", "us", or "our"), governing your access to and use of our website at voicetitans.com (the "Website") and any related services we provide.

By accessing the Website, submitting an enquiry, or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are accessing the Website on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

These Terms apply in addition to any separate agreements, service contracts, or speaker booking agreements entered into between you and Voice Titans.

Voice Titans is a speaker bureau and talent representation network. Our services include:

• Identifying, recommending, and facilitating the booking of keynote speakers, masterclass leaders, emcees, and other speaking talent for corporate events, conferences, and other engagements
• Providing event advisory, speaker briefing, and logistical coordination services
• Publishing educational content, speaker profiles, and industry insights via our website and blog

Voice Titans acts as an intermediary between clients and speakers. Unless expressly stated otherwise, we are not the employer or agent of any speaker and do not guarantee speaker availability, performance, or the outcome of any event.

3. Use of This Website

Permitted use

You may use this Website for lawful personal and professional purposes — to research speakers, submit enquiries, read our content, and engage our services.

Prohibited conduct

You agree not to:

• Use the Website in any way that violates applicable local, national, or international laws or regulations
• Reproduce, distribute, modify, or republish any content from this Website without our prior written consent
• Attempt to gain unauthorised access to any part of the Website, its servers, or connected systems
• Use automated tools (bots, scrapers, crawlers) to extract data from the Website without permission
• Contact speakers directly using information obtained through Voice Titans, in circumvention of our booking process

We reserve the right to suspend or terminate access to the Website for any user who violates these Terms.

4. Speaker Enquiries & Bookings

Enquiries

Submitting an enquiry through our Website does not constitute a confirmed booking. All enquiries are subject to speaker availability, confirmation of terms, and the execution of a separate booking agreement.

Booking agreements

All confirmed speaker bookings are governed by a separate written booking agreement or service contract, which will set out the specific terms including speaker fees, logistics, cancellation terms, and deliverables. In the event of any conflict between these Terms and a booking agreement, the booking agreement shall prevail.

Speaker information

Speaker profiles, biographies, fees, and availability on this Website are provided for general information purposes and are subject to change without notice. Voice Titans makes reasonable efforts to keep speaker information accurate but does not warrant the completeness or currency of any such information.

Exclusive representation

By engaging Voice Titans to source a speaker for a specific event, you agree not to approach that speaker directly or through a third party to circumvent Voice Titans' role in the booking. A circumvention fee equivalent to the full booking fee may be charged where this occurs.

5. Fees, Payment & Taxes

Speaker fees and service charges will be set out in the applicable booking agreement. Unless otherwise agreed in writing:

• All fees quoted are exclusive of applicable taxes (including Malaysian Sales and Service Tax, GST, or equivalent) unless expressly stated
• Payment terms will be specified in the booking agreement; late payments may attract interest or service charges
• Speaker fees are quoted in the currency specified in the booking agreement; currency fluctuation risk is borne by the client unless otherwise agreed
• Any additional costs incurred (travel, accommodation, visa fees, technical requirements) are payable by the client and will be set out in the booking agreement

6. Cancellations & Changes

Cancellation and change terms are set out in the specific booking agreement. As a general guide, the following principles apply:

• Client cancellations — cancellation fees may apply depending on the notice period. Fees paid to secure a booking may be non-refundable
• Speaker cancellations — Voice Titans will use reasonable endeavours to provide a suitable replacement speaker. Where a replacement is not possible, fees paid will be refunded pro-rata
• Force majeure — neither party shall be liable for cancellations caused by circumstances beyond reasonable control, including natural disasters, civil unrest, government action, or pandemic
• Event changes — changes to event date, format, or venue should be notified to Voice Titans as soon as possible. Changes may be subject to re-confirmation by the speaker and revised fees

7. Intellectual Property

Voice Titans content

All content on this Website — including text, graphics, logos, images, speaker profiles, blog articles, and the Voice Titans brand name and logo — is the property of Voice Titans or its licensors and is protected by Malaysian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, display, transmit, or create derivative works from any content on this Website without prior written permission from Voice Titans.

Speaker content

Speaker presentations, materials, videos, and other intellectual property remain the property of the respective speaker or their representatives, unless separately agreed in writing. Any rights to record, broadcast, or reproduce a speaker's content must be negotiated directly with Voice Titans as part of the booking agreement.

User submissions

By submitting content or information to us (including enquiry details or testimonials), you grant Voice Titans a non-exclusive, royalty-free licence to use that content for the purposes for which it was submitted.

8. Disclaimer of Warranties

The Website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Voice Titans makes no warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the Website will be uninterrupted, error-free, or free of viruses or other harmful components
• That speaker profiles, fees, or availability information is accurate, complete, or current at any given time
• That any speaker will achieve a particular outcome or audience response at an event

Nothing in these Terms excludes liability that cannot be excluded under applicable Malaysian law.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Voice Titans and its directors, employees, agents, and partners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or services
• Loss of profits, revenue, data, goodwill, or business opportunity
• The conduct, performance, or cancellation of any speaker
• Any errors, omissions, or inaccuracies in speaker profiles or content on the Website
• Unauthorised access to or alteration of your data or transmissions

Where liability cannot be excluded, it is limited to the total fees paid by you to Voice Titans in the three (3) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Voice Titans and its directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Website or services in violation of these Terms
• Any content or information you submit to Voice Titans that is false, misleading, or infringing
• Your violation of any applicable law or the rights of a third party
• Any direct approach or circumvention of Voice Titans' role in a speaker booking

11. Third-Party Content & Links

This Website may contain links to third-party websites, social media platforms, and speaker-managed content. These links are provided for your convenience only. Voice Titans does not endorse, control, or accept responsibility for the content, privacy practices, or services of any third-party website.

Your use of any linked third-party website is at your own risk and subject to that website's own terms and conditions.

Your use of this Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Website, you consent to the collection and use of your information as described in our Privacy Policy.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms or your use of the Website shall first be subject to good-faith negotiation between the parties. If a dispute cannot be resolved within 30 days of written notice, it shall be referred to and finally resolved by the courts of Malaysia, and you irrevocably submit to the exclusive jurisdiction of those courts.

Notwithstanding the above, Voice Titans reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
